In the past decade the number of employment tribunals has tripled - 130,000 cases were brought against employers last year alone. And as compensation levels rise, the cost to businesses is increasing dramatically.
The Confederation of British Industry has said the whole thing is getting out of control and the government is taking their complaints seriously, with the Department of Trade and Industry releasing a consultation paper on ways to cut the number of employees taking their complaints to tribunals.
In future, workers could be forced to pay to bring a claim and made to show they've exhausted the less formal alternatives to resolving the dispute. Will such proposals be a necessary curb on vexatious claimants or do they risk blocking access to justice to victims of workplace discrimination?
Martha discusses the issues with Louise Beard, Policy Director at the Birmingham Chamber of Commerce and Sarah Veale, Policy Officer, TUC.
