Eligibility

1. First Past the Post is a quiz open to all residents (over 18 years of age) of the UK, including the Channel Islands and the Isle of Man, except ³ÉÈËÂÛ̳ Group employees, their close relatives and anyone connected with the competition. Proof of age, identity and eligibility may be required. The ³ÉÈËÂÛ̳ reserves the right to disqualify any contestant or winner who breaches these rules.
How to Enter

2. First Past the Post will be run weekly during the Matt Chorley programme on ³ÉÈËÂÛ̳ Radio 5 Live (except when editorial requirements lead to a change in schedule or a change in programme content).

3. To be in with a chance of playing the quiz, get in touch with us, using one of the three methods outlined below, with your name, contact number and explain why you want to take part:

3.1. Email - chorley@bbc.co.uk ; or

3.2. SMS - 85058 (texts will be charged at your standard message rate for each message. Check with your network provider for exact costs); or

3.3. Whatsapp – 08085 909 693 (WhatsApp messages are free).

4. The First Past the Post production team will review eligible entries and shortlist contestants based on their explanation of why they want to play; this is an editorial decision and not all contestants will be shortlisted.

5. Qualifying stage:

5.1. Following the shortlisting stage outlined above:

5.2. Selected contestants called back will be asked about their general knowledge, interests, and hobbies.

5.3. Contestants may be asked additional questions about their news, politics and trivia knowledge and will be selected on how lively and interesting they will sound on air and how recently they have appeared on Radio 5 live.

6. All contestants put through to play on air must supply their name, postal address, and a daytime contact telephone number.

7. We will only accept one entry per person per day by any method listed above. Subsequent entries by the same person on the same day will be disregarded. If you do not hear from us or we have not been able to get in touch with you after reasonable attempts, you have been unsuccessful in reaching the qualifying stage and may try again after 28 days.

8. Two contestants will be chosen to take part in each week’s edition of First Past the Post and will be told which day they will be taking part in the competition. Each competition will be broadcast live. If a selected contestant is unavailable at the time the competition is to be broadcast, their participation will end and another contestant will be selected to take part in the on-air quiz. All entries will only be kept for 28 days. If you have not been successful in becoming an on-air contestant at the qualifying stage, you can apply again only after 28 days from entering.

On-Air Quiz

9. The two selected contestants for the day will each answer a series of 5 questions each and will be awarded points (called seats for the purpose of the quiz) based on the number of correct answers and as described on-air. In a final round the leading contestant will be given 15 seconds to name as many entries as possible from a list of the most popular of a given category as determined by publicly available polling carried out by a reputable polling firm. The second contestant will the be invited to attempt to complete the list, with points ("Seats”) awarded for each correct answer.

10. The contestant with the most points/Seats at the end of the round is the winner.

11. Winners will be invited back to play again the following week for a maximum of 5 weeks after which they will be retired and replaced.

The Prize

12. The prize for winning First Past the Post will include a keyring and a certificate.

13. The prizes are non-exchangeable, non-transferable, and are not redeemable for cash or other prizes.

14. The winner cannot copy or distribute the prize or copies of it. Any programme names, branding or logos on or associated with the prize cannot be used or reproduced by the winner in any way. The winner shall not do anything with the prize that might bring the ³ÉÈËÂÛ̳ in to disrepute.

General

15. The ³ÉÈËÂÛ̳'s decision as to contestants taking part is final. No correspondence relating to the competition will be entered into.

16. Each winner will be notified on-air at the end of each day's First Past the Post. Their name will be broadcast and they may appear on a First Past the Post leaderboard online and on social media.

17. Contestants agree to take part in any post-competition publicity.

18. The ³ÉÈËÂÛ̳ reserves the right to (i) cancel or vary First Past the Post at any stage, if deemed necessary in its opinion, or if circumstances arise beyond its control, (ii) disqualify any contestant who breaches the rules, has acted fraudulently in any way or has brought the ³ÉÈËÂÛ̳ into disrepute; (iii) where applicable, disqualify an contestant or winner, withdraw or substitute any prize, should any contestant, winner or their guest at any stage exhibit inappropriate or dangerous behaviour (including, but not limited to being under the influence of alcohol, illegal drugs or chemical substances or causing a nuisance) before or whilst on-air, attending ³ÉÈËÂÛ̳ premises or where the prize includes attendance to an event, exclusion from that event; and (iv) impose any additional entry restrictions or requirements should the prize being offered require such restrictions or requirements (including but not limited to tickets for events with an age minimum or other entry requirements).

19. Contestants chosen to play on-air will not be allowed to enter First Past the Post for the following 24 months, unless they are invited back the following week.

20. Contestants will be deemed to have accepted these rules and to agree to be bound by them when entering this competition.

21. On-air contestants must not receive any help in answering the questions and the ³ÉÈËÂÛ̳ reserves the right to disqualify any contestant it suspects of cheating.

22. The ³ÉÈËÂÛ̳, its sub-contractors, subsidiaries, affiliates and/or agencies cannot accept any responsibility whatsoever for any technical failure or malfunction, nor for any other problem which may result in any entry not being properly registered.

23. To the extent permitted by law, the ³ÉÈËÂÛ̳ will not be liable for any loss or damage (whether such damage or losses were foreseen, foreseeable, known or otherwise) including financial, reputational loss or disappointment.

24. The competition is run by the ³ÉÈËÂÛ̳. The applicable law is that of England and Wales.

Privacy Notice

Your trust is very important to us. This means the ³ÉÈËÂÛ̳ is committed to protecting the privacy and security of your personal data. It is important that you read this notice so that you are aware of how and why we are using such personal data. This privacy notice describes how we collect and use personal data about you during and after your relationship with us, in accordance with data protection law.

Why are we doing this and how can you participate?

Audiences are at the heart of everything we do at the ³ÉÈËÂÛ̳. We actively engage and ask our audience to take part and contribute in a variety of ways, including via email, SMS, and WhatsApp entry for radio competitions.

There is then a selection process to choose contestants to appear on-air as the next stage in the competition.

If you appear on-air, this may include the programme being available online and/or on demand, and your contribution may be used again in a future broadcast.

We may use your on-air appearance (if applicable) for promotional purposes on the ³ÉÈËÂÛ̳’s social media sites.

What personal data will the ³ÉÈËÂÛ̳ collect and how will we use it?

The ³ÉÈËÂÛ̳ will collect and process your personal data for the purposes of administering the competition; keeping a record of winners for compliance and auditing purposes; to create broadcast content; and to provide the winner with their prize.

Personal data

Depending on the nature of the competition, the ³ÉÈËÂÛ̳ may collect and process the following personal data about you:

  • Full name
  • Email address
  • Phone number
  • Location
  • Your opinions, answers to our questions and biographical information you may wish to share

We may also collect your postal address if you are a winner so that we can send you your prize (if applicable).

Who is the Data Controller?

The ³ÉÈËÂÛ̳ is the “Data Controller” of your personal data. This means that the ³ÉÈËÂÛ̳ decides what your personal data is used for, and the ways in which it is processed. For the avoidance of doubt, your personal data will be collected and processed solely for the purposes set out in this privacy notice. As the Data Controller, the ³ÉÈËÂÛ̳ has the responsibility to comply, and to demonstrate compliance with, data protection law.

If you use WhatsApp to contact us, this application is owned by Meta who are also a data controller for your data. We recommend that you read WhatsApp’s privacy policy for more information on how Meta will use your personal data when using the app.

Lawful basis for processing your personal data

The lawful basis on which the ³ÉÈËÂÛ̳ processes the personal data is the performance of its public task. The ³ÉÈËÂÛ̳’s role is to act in the public interest and to serve all audiences with content which informs, educates, and entertains.

We also have a legal obligation to process the personal data of the winners to comply with relevant competition regulations.

Sharing your personal data

The ³ÉÈËÂÛ̳ works with our approved third-party providers who help us to provide some of our services. These partners only use your personal data on behalf of the ³ÉÈËÂÛ̳ and not independently of the ³ÉÈËÂÛ̳.

We may share personal data with a third party where required or permitted by law.

Retaining your personal data

We keep records of winners for two (2) years for auditing and compliance purposes.

Unsuccessful entrants’ personal data that we receive by email will be deleted twenty-eight (28) days after submission. WhatsApp messages will be held for two (2) years. Personal data stored on the SMS system will be held for two (2) years.

Other personal data from unsuccessful entrants will be retained for 6 months.

If your contribution is used for broadcast, your personal data will be retained and archived in perpetuity by the ³ÉÈËÂÛ̳. 

Your personal data will be stored in the UK and the European Economic Area (EEA).

Your rights and more information

You have rights under data protection law:

  • You can request a copy of the personal data the ³ÉÈËÂÛ̳ stores about you.
  • You have the right to request that we rectify any inaccurate or incomplete personal data that we hold about you.
  • You have the right to ask for the personal data we collect about you to be deleted, however there are limitations and exceptions to this right which may entitle the ³ÉÈËÂÛ̳ to refuse your request.
  • In certain circumstances you have the right to restrict the processing of your personal data, or to object to the processing of your personal data.
  • You have the right to ask that we transfer the personal data to you or to another organisation, in certain circumstances.
